The presentence investigation, prior to a guilty finding, must include a history of Brittany Popovich co-parenting a child with a felon that has been convicted of robbery, criminal possession of dangerous drugs, probation violation, an escape charge and currently serving time in prison. The presentence investigation has to show that despite the connections with a felon, she was supervising felons in a correctional facility, Butte PreRelease.
The presentence investigation must include an interview with the victim, wherein probation and parole has an opportunity to tamper with the victim's statement. A male victim of sexual assault is no less egregious than a female victim of sexual assault. Probation and Parole, who will eventually have control of all aspects of this victim's life, now has the opportunity to control his victimization. The victim in this case is not yet a victim because there is no finding of guilt. He is a victim, because under Senate Bill 60 the defendant is assumed to be guilty, and at the mercy of Probation and Parole to treat him as a victim and not a felon. All this from Probation and Parole and the court has not yet given Probation and Parole jurisdiction over Brittany Popovich. She hasn't even filed a guilty plea or a finding of the court. Yet all this information is being collected to give to the judge with the assumption she is guilty.
This is a case where both the defendant and the victim are victimized by Senate Bill 60. The victim because the very people who will control his life also control his victimization and the defendant because she is presumed guilty and has to prove her innocence.
So, Probation and Parole, do your presentence investigation and continue to victimize the victim and presume someone is guilty before the finding. Senate Bill 60 authorizes you to do this.
This also kind of blows the Butte PreRelease mission of a team of individuals dedicated to meeting the human service needs of youth and adults to promote healthy living through treatment, training & supervision. Oh well, I guess that's prison.
Are pre-sentence investigations matters of public record? And, where can they be accessed? Thanks.
Patricia, per MCA 46-18-113, presentence investigations cannot be accessed by the public.
46-18-113. Availability of presentence investigation report. (1) All presentence investigation reports must be a part of the court record but may not be opened for public inspection. A copy of the presentence investigation report must be provided to the prosecution, the defendant and the defendant’s attorney, the probation and parole officer, and the agency or institution to which the defendant is committed. The prosecutor may disclose the contents of the presentence report to a victim of the offense.
(2) The court having jurisdiction of the case may permit other access to the presentence investigation report as it considers necessary.
